These Terms of Use ("Terms") constitute a binding agreement between you and Forged by Faith, LLC ("Forged by Faith," "we," "us," or "our") concerning your access to and use of forgedbyfaithtraining.com and any related webpages, booking functions, forms, and online services (collectively, the "Site"). By accessing the Site, submitting an inquiry, registering for a service, or making a payment through the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. About Our Services

Forged by Faith provides firearm safety, home protection, personal safety training, educational courses, certification-related training, speaking engagements, and related services. The Site provides information about these services and may allow users to inquire about, register for, book, and pay for available services.

Descriptions, dates, locations, instructors, course content, prerequisites, availability, and pricing may change. A website listing does not guarantee availability or eligibility to participate.

3. Eligibility and Participant Requirements

The Site is intended for adults. Registration or payment does not establish that a person satisfies all requirements for a particular course or activity. Certain services may have age, identification, legal eligibility, equipment, prerequisite, facility, range, certification, or other participation requirements.

Where minors are permitted to participate in a particular activity, participation may require the presence, authorization, and/or signature of a parent or legal guardian, together with any additional documents required for that course or facility.

4. Registration, Booking, and Payments

You agree to provide current and accurate information when submitting inquiries, registering, or making a purchase. Online payments may be processed by third-party payment providers made available through our website platform. Forged by Faith does not require users to create a traditional website account unless a particular service expressly provides otherwise.

Prices are stated in U.S. dollars unless otherwise indicated. You authorize the applicable payment provider to charge the payment method you submit for the amount shown at checkout. Additional terms of the payment provider may apply.

5. Cancellations, Rescheduling, and Refunds

Cancellations, rescheduling, transfers, credits, and refunds are governed by the cancellation or refund policy presented with the applicable course, event, booking, or purchase. If a separate written policy is provided at registration, that policy controls for that transaction.

Forged by Faith may cancel, postpone, relocate, or reschedule a course or event when reasonably necessary, including for instructor availability, facility or range conditions, weather, safety concerns, insufficient enrollment, or circumstances beyond our reasonable control. When we cancel or materially reschedule an event, we will communicate the available options applicable to that booking.

6. Training Services and Safety

Certain services involve in-person firearm safety, personal protection, home protection, and related educational training. Participation may be subject to additional eligibility requirements, safety rules, course-specific terms, waivers, releases, assumption-of-risk acknowledgments, and other documents provided before or at the time of participation.

Participants must comply with instructor directions, facility and range rules, and applicable safety requirements. Forged by Faith reserves the right to refuse, suspend, or discontinue participation when reasonably necessary for safety; when a participant fails to follow instructor directions or course/facility rules; when eligibility or prerequisite requirements are not satisfied; or when conduct may create an unsafe or materially disruptive environment.

Registration or payment through the Site does not waive or replace any separate participation requirement, waiver, release, acknowledgment, or safety agreement applicable to an in-person activity.

7. Certification-Related Courses

Some courses may be associated with a third-party certification or credentialing organization. Completion of a course does not guarantee issuance of a certification or credential unless all applicable requirements are satisfied. Where necessary to process course completion, certification, or credentials, participant information may be provided to the applicable certification or credentialing organization in accordance with our Privacy Policy and applicable law.

References to third-party organizations, certifications, trademarks, or course standards do not imply ownership or control of those organizations by Forged by Faith.

8. Educational Purpose; No Guarantee of Outcome

Training and information provided through the Site or our services are educational in nature. Individual results, skills, proficiency, certification outcomes, and real-world outcomes vary. Nothing on the Site constitutes a guarantee that participation will prevent injury, crime, loss, or other adverse events.

Content on the Site is not legal advice. Laws and regulations may change and may vary by jurisdiction. Users are responsible for understanding and complying with laws applicable to their own conduct, possession, transportation, storage, and use of firearms and other regulated items.

9. Intellectual Property

Unless otherwise stated, the Site and its original content, branding, logos, graphics, text, photographs, videos, course descriptions, downloadable materials, and other materials created by or for Forged by Faith are owned by or licensed to Forged by Faith and are protected by applicable intellectual-property laws.

You may use Site content for your personal or internal business use in connection with evaluating or purchasing our services. You may not reproduce, distribute, sell, publish, modify, create derivative works from, or commercially exploit our content without prior written permission, except as permitted by law.

10. Prohibited Uses

You may not misuse the Site; interfere with its security or operation; attempt unauthorized access; introduce malicious code; harvest information about other users; impersonate another person; use the Site for unlawful, fraudulent, or misleading purposes; or use the Site to advertise or offer your own goods or services without our prior written consent.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORGED BY FAITH AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF THE SITE OR AN ONLINE TRANSACTION.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR A CLAIM ARISING SOLELY FROM USE OF THE SITE OR AN ONLINE TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID TO FORGED BY FAITH FOR THE SERVICE OR TRANSACTION GIVING RISE TO THE CLAIM.

This Section is intended to address Site use and online transactions. It does not replace any separate participant waiver or release applicable to an in-person training activity, and it does not exclude liability that cannot lawfully be excluded or limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Forged by Faith and its members, managers, officers, employees, instructors, contractors, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Site, your material breach of these Terms, or content you submit in violation of another person's rights. This provision does not require you to indemnify a party for liability that may not lawfully be shifted to you.

17. Informal Dispute Resolution and Arbitration

Before initiating arbitration concerning a dispute arising from these Terms or use of the Site, the parties will first attempt in good faith to resolve the dispute through informal negotiations for at least thirty (30) days after written notice of the dispute is received.

18. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in a court of competent jurisdiction located in Morgan County, Alabama, and the parties consent to the personal jurisdiction and venue of such courts.

19. Changes to These Terms

We may update these Terms from time to time. The revised version will be effective when posted with an updated effective date unless a later date is stated. Material changes will apply prospectively to the extent required by law. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

20. Severability and No Waiver

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.

21. Entire Agreement; Course-Specific Terms

These Terms, together with the Privacy Policy and any policies expressly incorporated into them, govern use of the Site. Separate booking terms, course policies, waivers, releases, safety rules, certification requirements, or written service agreements may also apply to a particular transaction or activity. If a course-specific document expressly states that it controls over these Terms for that activity, the course-specific document controls to the extent of the conflict.
